TERMS & CONDITION.

GOBI RAID (referred to as "the Company") accepts bookings from (collectively referred to as "the Client") under the following terms and conditions:

1. Booking and Payments

1.1 The Client agrees to pay a deposit of 30% of the total tour price upon booking to confirm the reservation.
1.2 Once the down payment is received, the tour reservation is confirmed and blocked.
1.3 If the tour is scheduled to start within 16 weeks of booking, the full payment (100%) is required.
1.4 The Client is responsible for all bank fees associated with international transfers.
1.5 The remaining balance of the tour price must be paid no later than 10 weeks before the scheduled tour start date.
1.6 All payment details, including bank account information and the invoice, will be provided at the time of booking.
1.7 Payments must be made in Dollars ($).
1.8 A security deposit of $400 is required before the start of the tour. This deposit covers any damage to the bike or loss/damage of provided gear and will be fully refunded after the tour.

2. Cancellations, Licenses, and Visas

  • Travel Insurance: Clients are strongly advised to purchase travel insurance at the time of booking to cover the cost of cancellations for any reason.

    Refund policy for full payments received:

  • 12 weeks or more before departure: 90% refund

  • 8-11 weeks before departure: 30% refund

  • 5-7 weeks before departure: 20% refund

  • 0-5 weeks before departure: no refund

    Down payments are non-refundable for cancellations made less than 6 months before the tour. However, if the cancellation is due to "force majeure," payments may be credited for use on a future tour within 24 months.

2.1 Cancellations must be submitted in writing via email.
2.2 The Client confirms possession of a valid motorcycle driving license and/or necessary experience to ride an adventure bike.
2.3 Only the Client approved by the Company may operate the motorcycle.
2.4 The Client is responsible for any fines, legal costs, or other expenses resulting from traffic violations or any other issues caused by the Client during the tour.
2.5 If the Client fails to arrive at the specified tour start time, the Company will not be responsible for any refund or rescheduling.
2.6 If the Client is late arriving in Ulaanbaatar, an additional charge of approximately $400 will apply for transportation of the rider and bike to the rest of the group in the countryside.
2.7 If the Client or the group decides to cancel or alter the tour, additional transportation costs may apply to return the bikes to Ulaanbaatar. These costs will not exceed $500.
2.8 The Client is responsible for obtaining their own visa in advance, ideally 6-8 weeks before the trip. Failure to secure a visa or be allowed entry to Mongolia will result in no refund.

3. Responsible Driving, Liability, and Health

3.1 If the Client engages in any motorcycle stunts that cause damage, they will be responsible for covering the full cost of repairs.
3.2 The Client accepts the inherent risks and dangers of motorcycle travel, which may include, but are not limited to, traveling through rough terrain, encountering hazardous weather, wild animals, health issues related to extreme conditions, fatigue, and other physical challenges.
3.3 The Mongolian government enforces a zero-tolerance policy on alcohol. Clients must avoid excessive drinking before the tour's first day, as the police in Ulaanbaatar are strict about alcohol-related offenses.
3.4 The Client confirms they do not have any health conditions that could endanger themselves or others. If in doubt, they should consult a doctor in advance.
3.5 The bike provided to the Client remains their responsibility throughout the tour. Local individuals are not permitted to ride or sit on the bike without permission.
3.6 The Client is responsible for the gear provided and should ensure it is kept in the provided bag. Lost items will be deducted from the security deposit.
3.7 No rider is allowed to start the engine or operate the bike independently unless permitted by the tour leader.
3.8 Riders are not allowed to ride independently, especially in risky areas like the sand dunes of the Gobi Desert, unless given explicit permission by the tour leader.
3.9 The Client acknowledges and agrees that:
a) They are responsible for their own personal insurance, including repatriation, and understand the risks involved in the tour.
b) They will travel at their own risk.
c) The Company, its agents, and any other persons assisting with the tour are not liable for any personal loss, injury, accident, delay, or inconvenience, whether caused by the Company or external factors (e.g., weather, mechanical breakdowns).
d) Due to the nature of the tour, the Company is not responsible for any damage, loss, or accidents involving the Client's bike or personal property.
e) If the Client voluntarily leaves the tour or is asked to leave by a Company representative, all liability of the Company towards the Client will cease immediately. The Company will not be responsible for any additional costs, including transportation or repatriation.
3.10 The Company reserves the right to change tour dates or cancel a tour. If the Company cancels the tour, any payments made will be refunded in full.
3.11 The Client agrees to comply with all Mongolian laws, including those related to health, immigration, currency, drugs, and other regulations.
3.12 All distances and other information in the tour itineraries are approximate and may vary due to route changes, weather, or availability of accommodations.

4. Jurisdiction

Any disputes arising between the Client and the Company will be resolved under Mongolian jurisdiction.

5. Amendments and Modifications

The Company may modify these Terms and Conditions at any time. Reasonable efforts will be made to inform the Client of any significant changes.
